The Supremes

As I watched the Presidential traditional State of Union last night, the thought that the real power of the United States was siting in the first row below the podium where the President stood. They were sitting there in Black Robes and now have made the President a King.

Supreme Court associate justices Ketanji Brown Jackson, Clarence Thomas, Samuel A. Alito, Jr., Sonia Sotomayor and Neil M. Gorsuch were not present Tuesday at the joint Congressional address.

Curious, this morning I wondered where in the Constitution does it say that the Supremes have a life time tenure for this job. Article 3 in the Constitution says;

“The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office”.

The term good behavior has somehow become a lifetime tenure for the Supremes. Good behavior should be that one does not lie when taking the oath during a confirmation hearing and lies about settled law such as Roe V Wade. Roe v. Wade was a1973 Supreme Court case that legalized abortion nationwide. The decision ruled that the Constitution protects a person's right to privacy, which includes the right to control pregnancy. The ruling also stated that states cannot place undue restrictions on abortion.

Good Behavior should not include making up a ruling out of whole cloth that the President has immunity from crimes while in office. This ruling has had the effect of conferring upon the President he is above the law. We have been believing in our history That no Man is above the Law. Actually, these words are not anywhere in our Constitution. What is says is; that every one is equal before the law and that everyone has equal protection under the law. We know that with great wealth the legal system can be manipulated to find ways to divert, to delay, and sometimes to become a game where the rich find ways to not be held accountable.

The Supremes also did not have Good Behavior when they suspended the 14^th Amendment section 3. Clearly, Mr Trump did in fact create the mob which invaded our Capital on January 6, and tried to give him the presidency which he lost in the 2020 election. He is by definition an insurrectionist...

The Supremes take two oaths of Office;

The First Oath, The Constitutional Oath; "I, ________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God."

The Second Oath, is the Judicial Oath; "I, ________, do solemnly swear or affirm that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as _________, according to the best of my abilities and understanding, agreeably to the constitution and laws of the United States. So help me God."

Dear Mr. Franklin it seems that keeping our Republic is becoming more challenging without our Courts fulfilling their oaths and a President who continues to flout the law...
